Powers of Executor

My Mother died recently. Everything was left equally to my Brother and myself.

My Brother was appointed Executor. He has since, changed locks on the family home, taken ownership of my Mothers car and begun throwing things away and moving items he wishes to a storage unit.

We orignally aggreed to not move anything out of the house. Also, I had been staying in the home, mainly so I could insure things I wanted were not tossed or removed. Now I have no key and they will not let me enter the house

Seems to me he is abusing his power by having access to all the personal property without any supervision. (I found out about storage unit by accident)

In addition, I do not wish to sell the house, but wanted to keep it if possible, but the monies have yet to be known. Does he have to have my signature before he sells the house?

And last but not least...how do I file a motion to have him removed as executor. Thank you .

You should contact an attorney ASAP who works in the Probate practice area. You should do so immediately. Contact your local Bar association or ask for a referral but you need to address this without delay.
