Legal Question in Wills and Trusts in Alabama

Requests not in will

My parents, had a will done, just before my dad passed away. She was sole beneficiary. The will states that at the time of her death, all properties are to be split equally, between my two brothers and me, with me being executor. My question: For the past 13 or more years, my mom has paid bills for and given money to and even an automobile, totaling at least $30,000, to my oldest brother who is in financial distress. To this day, she continues to support him. She has told me, that when the time comes she has all documentation of how much she has given him, and that is to be deducted from his part at the time of her death. Is this something she needs to have added to her will?

Re: Requests not in will

If your mother dies without a will your brother will get an equal share, regardless of her wishes, and regardless of what she's given him.

Bottom line: get a will.
