Legal Question in Family Law in Alaska

divorce

06-2006 I went to a holiday to my homecountry,Czech Republic and my husband did not want me to come back for some reason. I lef all my staff, money in Alaska. Now he wants me to sign a blank divorce paper, 05-2007, and he said he does not owed me anything. We dont have any children. I am also green card holder but my green card has already expired. I can not be present at the court, neither can get my stuff. He also cancelled my credit card, my health insurance. We have a joint bank account and all money I earned is gone. I was a teacher. He was also abusive husband but I never want to left the State forever but he threaned me that he hurt me if I come back from the holiday. He is under psychiatric treatment, he suffer from depression, but he probably stopped taking the pill, antidepressant. Is there any chance he can divorce without my agreement ? I have also registered gun in Alaska, how can I canceled it if I dont live there anymore ? I live in Europe righ now.Can he fake my signature how he said ? How can I divorce and get my money and my stuff ?

Re: divorce

You should not have left the country (and certainly not for so long), because you had rights in this situation that will now be extremely difficult to enforce.

You're going to have to hire a lawyer in the state to handle your affairs.

You may need to come back at least for a court date, or to ask for the court to allow you to testify by video conference--you don't need a green card for that.

Abused foreign spouses have access to protection under VAWA,--find an attorney who understands what that is and has experience working with it. There may be some relief there.
