Legal Question in Family Law in Alaska

Help with Process

I got screwed in my divorce. The few things that the decree spelled out, I have not received. My divorce decree stipulated that I recieve a fixed dollar amount by a certain date. That date passed by many months ago and still have recieved nothing.

I want to know how I proceed. Is this now a civil matter that requires me to sue for enforcement of the court order or do I hire an attorney to file a motion or what?

I could really use some advice. Thanks.

Re: Help with Process

Assuming that the divorce occurred in Alaska, you would file a motion for order to show cause why your ex-spouse should not be held in contempt for not abiding by the court order. Its a fairly straight-forward motion. You can also ask for attorney fees and costs for making it, although they are not always granted. However, the court will expect your ex-spouse to follow its order, and bring him or her before the judge to explain why he/she hasn't done so. Ultimately, if he/she doesn't pay, you can garnish wages, take the APFD, etc. I hope this helps you.
