Legal Question in Real Estate Law in Alaska

easements

I need help with an easement that lies accross the front of my home. It was to be temporal AND SOMEHOW THE WORD PERPETUAL GOT IN THE DOCUMENT.The last owners told me they would abandon it and then sold their home with the easement intact to ''the neighbors from hell'' I feel that they are misusing the easement to force us to sell the home to them at a huge loss which they will then remove the easement and resell the property without the easement. They are in the real estate business.

Re: easements

It is difficult to suggest an answer when one still doesn't really know what the question is. You don't say what kind of easement it is, how it originated, or how it is being abused. All of those facts, and probably more, would be needed before any attempt to assess your rights and remedies in this situation.

In general, under certain circumstances, easements can be extinguished through nonuse or abuse. Please feel free to contact me directly if you wish to pursue this matter further.
