I have been paying on an owner financed property since Janurary. So far I have missed to payments. However, child services have been called on me and I am afraid that I will be forced to move or lose my children because the place may not be fit to live. I have just recently found out that it may be infested with black mold. If I walk because of this can I get back my ernist money?

It depends.
Do you have a contract to purchase the property or, on the other hand, did you actually purchase it, subject to a deed of trust given the seller?
Was this sale done through a realtor or attorney? Did you pay for a home inspection at the time you purchased the home? Those are some of the questions which should be addressed before a reliable answer can be given.
