He was already on probation for a prior felony conviction in 2009 for unlawful discharge of a hangun in city limits. i checked the status of his case on the superior court website and under the diposition code it says that the charges were dismissed due to grand jury indictment. In Maricopa County most cases are charged then sent through the Preliminary Hearing process. If your boyfriend exercised his right to a preliminary hearing then the State usually does not do the preliminary hearing they just put the same case in front of the grand jury; if the grand jury returns a true bill then they dismiss the case at the Preliminary hearing level.

To put it simply, your boyfriends case has not gone away they just dismissed his case, then refiled it immediately.
