Small Claims

I live in the state of California and I will have to rent a vehicle to drive to Arizona to file my claim and to go to court. Am I able to add these expenses to my small claims cost? Also I purchased a car with this person, the title is in both of our names, can I add the cost of the trade in car (wich was mine ) to the small claims since I no longer have access to this vehicle?Thank you

Dear Small Claims:

Unfortunately, writs and appeals does not cover your query and since I am a California lawyer I am not the best source for Arizona legal questions. Additionally, it is difficult to determine the extent of your rights in regard to the vehicle without knowing the nature of your agreement with the other individual. However, generally you are entitled to costs if you succeed and damages whatever they might be. I doubt your transportation expenses would fall within either category. Depending on the nature of your agreement you are probably entitled to claim as damages the value of your tradein vehicle to the extent it is greater than what the other party contributed to the arrangement. Again, this is not my area of expertise and you may want to pose the question to someone from Arizona or someone involved in civil litigation. Good luck.

you should be able to buy the forms and file them by mail. that will save you one trip.
