Legal Question in Banking Law in Arizona

My debit card was taken from my motel room, used at an ATM, and put back. They had to be watching me previously to know pin. I was out working on my car. My bank doesn't believe me. Basically calling me a liar. I would not do that. 6 year customer! They are threatening to report to credit agencies. I didn't notice until next day. No police report. They have no proof it didn't happen! Do I have any ground here? Can I get my money back? $400.00.

Depending on which bank you used, often an ATM machine is loaded with a camera which snaps a picture of the person who made the transaction. Not all banks and ATM machines have that device. That may be a place to start to determine who used the ATM machine. Crooks sometimes have "card readers" which steal the pin number when they come behind you and use equipment at gas stations, ATM machines, etc I am not sure what is going on with your bank, threatening to report information to credit agencies.
