Legal Question in Business Law in Arizona

False Better Business Bureau Claim

Recently, a client of our filed a complaint against us with the BBB, of which we are a member. The written documentation that they submitted to support their claim consisted of an e-mail they claimed they received from our company. Upon review, we discovered that the client actually modified the e-mail prior to submitting it to the BBB. The BBB claims they will not remove the claim despite the fact that we have notified them of it's fraudelnt nature. They state that they cannot remove claims unless initiated by the compaintant, which obviously isn't going to happen. What are our options here? Clearly this is damaging our name, and is based on a fraudelent claim.

I will add to the two answers already posted. A formal demand, sent certified mail, for a retraction by the complainant, with a deadline of 7 days. That would help you if you sue.

File a response to the complaint attaching both the altered and unaltered Emails; request that your response be included in your file to be delivered to anyone who inquires about the current dispute.

Re: False Better Business Bureau Claim

You could bring a suit against the complainant for defamation, publishing false statements which injure you in your trade and business. You can also demand that the BBB show your explanation and denial of the bad report along with the complaint filed by the bad guy.
