Legal Question in Construction Law in Arizona

I have an issue where we recently purchased a Richmond American home in Mesa, AZ 85205, and our house nearly flooded recently after an intense rain, right to the point of water entering at the level of our sliding glass door, the cement slab was also completely under water. In fact it recently rained again and our back yard flooded again. i complained and they sent out an engineer to test the grade and it failed. The graders came to fix it according to the measurements but determined it could not be fixed because the yard will never drain properly due to the landscaping in the front of the side yard and the driveway towards the rear being at a higher elevation than the yard itself. The only solution is to put in a french drain. The builder came out today and suggested a fix which wouldn't remedy the grade and our yard would still not drain properly. I was wondering what our options are?
