Legal Question in Criminal Law in Arizona

Last April, my former employer filed a civil suit against my husband and I for $4700 for damages to our apt. He filled out the move in/move out sheet himself and our last active lease was in 2009. We made him a offer of $4000 and we were in the process of signing the papaers. The I received an summons form the court that I was being charged with a class 3 felony for theft. Can he do this?

"He" is not doing anything. The State of Arizona decides whether or not charges will be filed. It is clear that there is interrelation of civil and criminal proceedings and that one is likely being used to manipulate the other.
