Legal Question in Criminal Law in Arizona

shoplifting trial

I was in a Circle K about a year and a half ago. I had brought in a cell phone component that I bought at another circle K to exchange because it did not fit my phone. When I walked in I immediately went to the cell phone section, didn't see the one I needed and proceeded to the register to buy gas. once I was up there I put the assessory I had put brought in to the store in my purse. the mgr stopped me and asked if I was going to pay for it. I explained the situation and she insisted I stole it. I ended up paying for my gas, pumping it and leaving. A week later I got a call from a police officer. They ended up calling 911. I gave the office my statement exactly how it happened and asked if they had it on tape. she said no, even though I was right in front of it. the PO charged me. Shortly after,I ran into fin hardship and long story short, didn't show up for court. I ended up going back to court a few weeks ago and got a pretrial conference. Because I have been convicted before of shoplifting they wanted jail time. Now we have a trial set and they are going to have to contact the witnesses. IF the witnesses do not work at that circle K still, they cant testify right? Should I seek a personal attoney for this?

Re: shoplifting trial

The witnesses may testify if they are available, whether or not they still work for Circle K. If the state is asking for jail time, your best advice is to obtain the services of a local criminal law attorney. There may be other options available to you which are more desireable.
