If the card was used to acquire goods or services, such as fuel, the state could charge you with theft. The class of theft would depend upon the value of the fuel. $25,000 is a class 2 felony, $4,000 to $25,000 is a class 3, $3,000 to $4,000 is a class 4 felony, $2,000 to $3,000 is a class 5 felony, $1,000 to $2,000 is a class 6 felony and less than $1,000 is a misdemeanor.

One could be charged with Fraudulent Use of a Credit Card and the penalty depends on the value of the goods obtained ranging from a class 5 felony to a misdemeanor.

A third charge is possible, Receipt of Anything of Value Obtained by Fraudulent Use of a Credit Card and the penalty also may range from a class 5 felony to a misdemeanor, depending on the value of goods received.
