Legal Question in DUI Law in Arizona

False charges

What can be done in a case where you are stopped by police and given a breath test and other standard tests (of which you pass all of them) and still arrested and charged with DUI? In this case I am referring to a 17 yr. old at the time of the arrest and now a year and a half later is summoned to appear in court on these charges?

Re: False charges

There are several things that can be done. Firstly, there may be procedural issues that may bar prosecution, i.e. the delay in prosecution. If the facts are as you present them, this is a very defendable case. Were there any drugs found in the arrested persons blood or urine. Also did the police do a drug recognition examination (DRE)?
