Legal Question in Elder Law in Arizona

Sold house wrongfully???

My fiance has a grandmother who is still living and her grandfather past away last July. In both of their wills, the house and the content was to be left to my fiance and her brother. The grandmother was diagnosed with dimentia and her grandmothers daughter has power of attorney. The daughter sold the house without giving anything to my fiance or brother and the daughter said it was because she has power of attorney. The letter from the doctor stating the dimentia was dated well prior to th daughter selling the house. Does my fiance have a case that she should look into getting a lawyer so that she and her brother can rightfully get back that house?

Yes. She should consult an attorney who can review all of the facts and advise her if legal action can be taken to recoup the monies which might have been wrongfully taken by the daughter with power of attorney.

Re: Sold house wrongfully???

The money is probably long gone. She should have gotten an attorney involved long ago. Maybe there is something left to collect.
