adoption

my x husband left our daughter when she was 3 and had no contact for two years and then called one day wanting to talk to her I didn't allow it because she was in therapy and it was advised to not due to his UN- treated bi-polar I am now seeking adoption with her step dad. my x is fighting me on this wanting a relationship now with her she is 9 what are my rights

The judge should consider your wishes as to the adoption. However, he will also consider the father's. That the father has mental health issues and abandoned your child for two years should help your case. Ultimately it will be the judge's decision.

You have at least equal rights with the other parent over your shared child. You may have an edge because of your greater stability, mental and otherwise. However, for "stepdad" to adopt, real dad would have to relinquish all parental rights. Good luck!
