Legal Question in Family Law in Arizona

Changing Jurisdiction

I now live in Arizona with my daughter who I have physical custody of. I want to change my court order for visitation, but it was ordered in North Dakota. How do I change jurisdiction from North Dakota to Arizona? The father does not live in North Dakota either.

Re: Changing Jurisdiction

You must first "domesticate" your "foreign" Order. Then, so long as the child has lived here for more than 6 months, I would expect you could file a Petition to Modify Custody with no concerns re: jurisdiction (on the custody issue, at least. There may be a jurisdictional problem regarding child support if you also wanted that modified).

To domesticate, you need a certified copy of your foreign order. I can explain the procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Audrey to schedule a free 1/2 hour consultation. I look forward to talking with you.
