Legal Question in Family Law in Arizona

Custody: I currently have all 3 of my children (4,3 and 11 months) and their father is currently facing a class 3 Felony of Child Abuse and Domestic Violence. I have filed the divorce papers and now I'm just waiting. My Question is: What are my chances of having sole custody of my children and what do I need to do to insure that my children cannot be with their father ever due to their safety?

Your chances are fairly good, although right now it sounds like these are just criminal charges, not convictions. The Court will likely want to know the outcome of the prosecution before it makes a final determination of custody and visitation. Most likely you will get sole physical custody and the father some type of visitation, maybe supervised. It is unlikely that a court would say the children could NEVER be with their father. For example, there are organizations that provide neutral spaces for visitation to take place, with very tight security. And after they turn 18 they can do whatever they want.

Best of luck to you!
