Legal Question in Family Law in Arizona

my dad has been in a toxic relationship for 14 years with my step mom. My dad cant handle it anymore and has started filling out the divorce papers. He wants to move out because with his heart condition the environment is taking a tole on him. If he moves out, can she get him for child abandonment? If he leaves and still attempts to see the kids, she probably wont allow him to make it look like he doesnt try.

Your Dad should speak with an experienced attorney. While moving out will not be "abandonment", there are certain things he should consider before doing so. He may desire to file for Divorce right away, or even in advance of moving, and file a Petition for Temporary Orders. That is the quickest manner of getting before the Judge if Mom is unreasonable about his access to the children.
