Legal Question in Family Law in Arizona

Divorce decree

My wife, of thirteen years, presented me with divorce papers, November 2002.

Though we're in a community property state and I have offered to divide all property, she wants more. Thus, we have not been able to come to a settlement agreement.

There are no children involved.

Now I've received a request to renew the divorce action which is up on August 15th.

What happens if I refuse to sign the renewal?

Thank you for your response.

Re: Divorce decree

First of all is there a reason she will not divide everything in half, for example do you make a lot more money than she does? What happened to the divorce actin filed in Nov. 2002? Was it dismissed or did it go throught. Is the request for renewal a motion to cont. on the inactive calender? Just be careful, you do not what to be defaulted. There are few questions that need to be answered. Also is this a AZ or NV case? Good Luck and pay attention to the documents you may receive. The last thing you want is to be in default.

Re: Divorce decree

The Court can choose to renew the matter even if you do not agree. If the matter is not renewed, she can simply choose to refile a new Petition, and the new date for determining the division of property and debts would be the date of service of the second Petition. This can have positive or negative financial repercussions.

I can explain the issues better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Audrey to schedule a free 1/2 hour consultation. I look forward to talking with you.
