Is there a way in a Domestic Violence situation to get divorced without going thru all the hoops of the system?? I have filed my papers, tried to serve the other person with no luck and now have been told that I must advertise in newpapers that will cost me over $500 to do, I don't have the money to do that. Is there a way around that step to getting a court date?? I have been at this for 2yrs now....

In order to get divorced, you must provide the other party with notice of the proceedings. If you are unable to get him served after reasonable efforts, the court can give you permission to give notice in other ways, which may include publication in a newspaper.

You should speak with an attorney to determine what your best options are in order to move forward with your case.

Well, both Monica and Ronee are right. You don't NEED to talk to an attorney, but it wouldn't hurt, either. You need to file a Motion for Alternative Service. At the same time, publish in your jurisdiction (the Record Reporter is the cheapest here that I've found in Maricopa County). If he's not in Maricopa county, you'll need to publish in his county, too, and may have to make some phone calls to find a cheap paper to publish in.

You don't have to speak with a lawyer. File a motion requesting an alternative form of service if you have some idea where he is.
