Legal Question in Family Law in Arizona

Can he get everything in the divorce?

I have been married for two years. I am scared of this person, no real counts of physical abuse but emotional abuse and such have occured. I cannot handle it anymore. I know it's not healthy for the step kids either. I am ready to get out however he keeps threatning that if I leave he will take everything and anything and that he will make it so I have to pay spousal support.

My question:

When we married he was working full time as well as getting a Social Security Disability Check. He quit working and is now just Drawing SSD. If I divorce him will I end up paying spousal maintanence because he has not worked for the last year?

Also, one of the vehicles are mine. He is saying that since I owed him money when we got married ($1200) that he will get the car in the divorce (it's worth about 10K) is this true? Won't he just get his truck and I get my car?

Re: Can he get everything in the divorce?

Thank you for your inquiry. The law requires equitable distribution of any assets or debts accrued during the marriage. Spousal maintenance is rare after short marriages, but we'd need additional information before advising you on the likelihood of him prevailing on a claim. We offer a free initial consultation, so please contact our office to schedule a time to speak with one of our attorneys regarding the details of your case.
