Legal Question in Family Law in Arizona

Ex-spouse refuses to sign authorization for daughter to drive.

I am a divorced mom of two children ages 15 and 16. My ex-husband and I share joint custody of both children. I live in Arizona with my 16 year old

daughter and my 15 year old son lives with his father in California. My daughter wants to get her driver's license. I sent the application form to

my ex-husband to sign and notorize, because this is what it stated to do since we have joint custody. My daughter and ex- husband do not want a relationship with each other, however my ex-husband refuses to sign the paper. Could you give me some advice on what my options would be so I can help my daughter get her driver's license. Please let me know any further information I could give you to help.

Thank you

Re: Ex-spouse refuses to sign authorization for daughter to drive.

First, I would question whether you truly need his signature. Under Arizona law, major decisions that must be agreed to include major medical, religious or educational issues. Or, does your actual Court Order cover this precise issue?

If not, then it might be fine to simply sign the application yourself.

If DMV is requiring both signatures, or your Court Orders require both signatures, then perhaps the only way to force his signature is to ask for a hearing.

I can explain the procedures better by phone or in person. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Cathy to schedule a free 1/2 hour consultation. I look forward to talking with you.
