Girlfriends child

My brother has been raising his x-girlfriends child he doesn't pay child support on her her bio father does, but he has never even seen her. So my question is does my brother has any legal rights to her. Since he is the only dad she's ever known?

If he has been caring for her for greater than six months and has been abandoned by the other parents he may be able to seek custody of her "in loco parentis." This means standing in place of the parent. He should take a look at the statute to ensure he fits the law.
