Legal Question in Family Law in Arizona

Property Settlement forcing sale of home?

I signed a Property settlement on 3/30 aggreeing to refinance, assume, or sell our house within 60 days. I started the assumption process with the mortgage co. 1 week later with a $300 nonrefundable fee. It has been 4 months and my ex-wifes attorney is threatening to get a court order to sell my house in 2 weeks. The mortgage company says they are backloged and my loan assumption will be processed in 60 days. Can my wifes attorney force the sale of my house even though I am doing everything possible to assume the mortgage myself. Can I be legally penalized because the mortgage company has a backlog. If so, do I have any legal recourse.

the court will probably give you additional time on this under these circumstances. please call 1-800-677-1010 to schedule a phone consultation which costs $75.00.
