Legal Question in Family Law in Arizona

I recently relocated to AZ from AL to be closer to my children who live with my x wife about 5 hours away in the southern part of the state. I just got a message on FB saying she wants to move the children to Iowa very soon. We have join legal custody in the divorce agreement but it states nothing about moving from state to state. How do i keep my children in AZ i cant live the rest of my life chasing her and her unemployed live-in boyfriend across the country. help please :)

In order to be helpful, it would be necessary for me to review your divorce decree. When a divorce decree does not include critical provisions, Arizona law is the default provision. Sometimes it may be necessary to modify the decree to prevent relocation. If Arizona is the child's home state, it may be necessary to Petition the Court to prevent the relocation if that is in the best interest of the child. Arizona Law requires a statutory time period that each parent must notify the other regarding an intent to relocate the child. If you would like us to review your divorce decree and help you put a strategy in place to prevent the relocation, I suggest that you call Stephanie Coulter at 602 462 1004 to make arrangements for us to review your divorce decree so that we can provide you with a strategy to resolve the problem.

We can certainly help you consider and then pursue your options. This is obviously a very important matter, and you should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
