Legal Question in Family Law in Arizona

Here's the situation. My husband and I are going through a divorce in Arizona. I am an Az. resident. He is a Pennsylvania. resident. We are both ordered to be present at the mediation (for child support and visitation matters; we have one child who is 3 years old). The marriage has not yet been dissolved. We have a status report hearing sometime in October (which is a couple months from now) to report whether visitation was established and settled.

I have been offered a job, place to live and a vehicle through a friend of mine in the state of Arkansas. My question is this: after visitation is settled, will I be able to move out of state while the divorce is still not finalized? I need to better my living situation and I'd rather not wait another 3 or 4 months to be able to move and start working. I need to know if I can transfer a divorce case or if I need to stay in the state of Arizona to do so. I also need to know if it would be wise to settle everything in the state of Az., where the petition was originally filed by myself.

I have been representing myself, here. But I have a friend who is an attorney in Ar. and she is willing to work with me if my case is transferred. Any advice will be greatly appreciated. Thank you!

If you are seekeing to relocate, you should make relocation a topic at mediation. You also should amend your pleadings to seek relocation on a temporary and permanent basis. Will Father object?

We can certainly help you consider and then pursue your options in your pending dissolution matter. This is obviously a very important matter, and you should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
