Legal Question in Family Law in Arizona

Going after ex wife for Support

I have two step children, My spouses ex wife refuses to work. We have full custody and she gets the kids one night a week for four hours. For the last two years of marriage she has worked at seven different jobs and only twice have we received support. Can we go after her spouse's paycheck for support? If not what are our other options to force her to pay. She only pays $85 a month for both children.

Re: Going after ex wife for Support

You cannot garnish her spouse's check. You can seek "contempt" remedies, which can include incarceration, suspension of her driver's license, a lien against any real property she may own, a lien against any bank accounts she is part owner of (which can make her spouse's life a little more difficult".

We can absolutely help.

I can explain the issues and procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia or my paralegal Jennifer to schedule a free 1/2 hour consultation.
