My ex fiance is asking for the engagement ring back and is now threatening lawsuit against me can he do this? the ring was given to me on my brithday

You will need to prove that your ex-fiancee gave you the "engagement ring" as a unconditional gift out of love and affection. You can use evidence of the length of time of you total involvement with him,pictures of you and he together,other gifts he has given you,love letters re marriage and related issues and any prepatory efforts and plans you made to prepare for marriage to him.

I would tell also tell him in writing that if he pursues the ring issue or bothers you any further about it you are going to retain an attorney and sue him for Breach of Contract for Marriage,Fraudulent Inducement for Marriage,Negligent Misrepresentation of Marriage,Intentional or/and Negligent Misrepsentation of Marriage etc and seek punitive damages,attorney fees and costs.

That you will also file an Application for an Order of Protection and seek a Peace Bond (money the Court orders him to pay to the court) to prevent him from harrassing you about the matter of the ring.
