Legal Question in Immigration Law in Arizona

I Am an american born citizen, my husband arrived in the us in 3/2007 illegally, we got married in 11/2008 and our first child was born in 10/2009 he had tried to come across illegally in 9/2001 and was caught they took his picture and fingerprints but he never signed anything. He previously had a visa but never used it to enter the us. what are his chances of receiving a green card or residiency? and what is the correct process.

If his last entry was without inspection, he will have to file for his green card at a U.S. Consulate abroad with a waiver. If he has entered the country without inspection twice, there is no waiver available to him.
