Legal Question in Landlord & Tenant Law in Arizona

Do I have to pay late charges to my rent if I dropped off the remainder on the evening of the last day rent is due? I signed a form saying I would pay the remainder of the rent plus any late charges assuming I wasn't going to have the funds by that night. However, I got paid two nights prior to negotiated date and ended up getting a money order that night instead. Do I have to pay the other charges still?

The question is when was it due? By 5:00 pm that day? If they actually didn't receive it by the deadline, then they can bill you. If you just dropped it off when no one was there, that means they didn't actually accept the payment until the next morning when they got there.

Usually when something is due by a certain day, it is due by the close of business that day. If the deal you had specifically said "that night", then you may have a good argument. The problem is how are you going to prove you dropped it off that night when no one was there?
