Legal Question in Legal Ethics in Arizona

My sisterinlaw as Lou Gehrigs disease. She has made it known that she does not want to go to

a nursing home. The person who has the POA health is influenced greatly by her motherinlaw who is

a stepdaughter to my sisterinlaw. My sisterinlaw married 10 years ago. This stepdaughter wants to put my sisterinlaw in a nursing home and says as soon as my sisterinlaw cannot write or speak that

is what she plans to do. Can a person with a POA do that? Even though my sisterinlaw can not

communicate, she has and still does insist that she wants to die at home. Please help. I am

my sisterinlaw's only advocate.

It appears that the court should be involved to assist your sister in law to obtaing a guardian, who can make legal decisions with supervision by the court. you may also need a conservator if your sister in law has assets which must be managed. If you would like help, kindly contact Stephanie Coulter of this office at 602 462 1004 to make arrangements to schedule a consultation to review this matter.
