Legal Question in Medical Malpractice in Arizona

Do I have a medical malpractice suit? My mother went for a regular cataract surgery and she was seeing spots. In 2006, the doctors perform an lens transplant but after that she lost her sight completely. Now, they want to remove her eye and she is devastated. We told the doctors that she was losing her sight and all we got is �she will get it back� We live in Arizona and we don�t know what to do.

Any right to claim negligence by a doctor belongs to the party who was injuried. In this case, if the treatment was given to your mother, she has the rights, not you. The short answer is, you do not have a medical malpractice suit, but your mother may have one, if the doctor did something that was below the standard of care. Your mother should have her case reviewed by another eye doctor to determine whether her doctor failed to perform within the standard of care.
