Legal Question in Personal Injury in Arizona

community property

I am receiving a settlement from an insurance company. My wife has yet to file hers yet with the same. They say the draft and the check has to be in both our names since we live in a community property state. Arizona. Are they trying to trick us and settle both our claims by us both signing the check?

She should not sign a release until her claim is totally paid and received as to all aspects. That said, it would depend upon the wording of the release, which we do not have in front of us. We do not have all the facts.

Consult with an attorney about the possibility of representation on her claim anyway. I do not understand why you would want to go up against insurance companies without representation. Do not be taken advantage of. See an attorney.
