Homeowner Liability when homeowner is renting to son and daughter in law

neighbors dog running amuk. after several warnings of az. leash law destruction of vegetation with no results told dog owner i was taking their dog to dog pound and he would have to pay to get him back, this person stated "go ahead i don't even like the dog".while trying to aprehend the dog victim received a dog bite and fracture.insurance co. denies claim under theory homeowner doesn't live there.Question Is insurance co. required to settle?.'

I would need more information as to location of dog, i.e. dog at large or on within boundaries of owner's property? also, be aware that in Arizona any evidence of provocation toward the dog will prevent you from obtaining compensation for your injuries. Please feel free to call and discuss.
