Legal Question in Real Estate Law in Arizona

20 foot easement

I have a 40 acre parcel, fenced, residence on it, with a 20 ft easement on the North side (the fence is set back the 20 ft) the other side is State Land. A private party severely graded the easement ripping through natural arroyos and hills and plowing dirt over the fence (damaging fence). Can they do that? They are paying to have electric Co bring poles, but electric co says they didn't do any grading or pay for any grading... it was done by the private party.

Re: 20 foot easement

You do not state which county the property is in.

You may have a claim for damages against the party who did the grading. See a real estate attorney who files damage suits, and does so in the county where the property lies.

Good luck.
