Adverse Possession

If adjoining landowner is blocking access to property, does such blockage constitute a defense to adverse possession?

Re: Adverse Possession

I presume you mean to ask if the owner's blocking access to his own property will interfere with a squatter's claim of adverse possession.

It probably will, since adverse possession must be continuous and exclusive for the statutory period.

No opinion can really be given on this in a forum like this, since many facts, and possibly documents, must be examined to determine rights and possible claims of parties. Present the entire case, with documents and possibly photos to an attorney for a legitimate opinion.

Best regards,

James D. Jenkins
