Legal Question in Real Estate Law in Arizona

Property Contract Fraud?

My son lives in Europe. He wanted to purchase property in AZ, but couldn't get financing. So his mother did all of the papers in her name only. He paid and is paying all of the expenses. Now she says that if he doesn't ''purchase the property'' it belongs to her.

Dear LawGuru User:

Oral contracts cannot create ownership interests in real property. I do not have enough information from what you have told me to give a definitive answer to your question, but I believe that without a contract between your son and his mother, his mother is not obligated to give him an ownership interest in the property.

There are certain litigation strategies such as "quantum meruit" which may be of assistance to your son, and to find out more about that I suggest that he contact a litigation attorney.

Please let me know if you have further questions.

Thank you for contacting LawGuru.

Sincerely,

Louise Aron
