Legal Question in Real Estate Law in Arizona

I own property in the desert that shares a well with 6 other properties. Mine is vacant, using no water but one is growing fruit trees. How can I have the well share changed to reflect usage instead of everyone pays equal?

This can typically be done through a well sharing agreement and the installation of a water meter for each property. I have considerable experience with well users, and things seem to work out best when you have a system that monitors usage and has the property owners pay accordingly. If they are using more water, they are utilizing the pump more (increased wear and tear) as well as more electricity and/or fuel to keep the pump running. Same goes for the impact on the water lines.

I have prepared many well use agreements and represent water users, joint well users and water companies. If you would be interested in discussing the matter further, or having me prepare a well use agreement, feel free to contact me.
