Unfair lease termination by landlord

I rec'd a 30 day eviction notice because it was said that my 7 year old daughter went into a unit that was being vacated and turned on the water and stove. There was a group of kids, and she says she didn't turn on anything - one of the other kids that went in did. I feel that we're being made an example of because the new management has made it clear that they don't like kids out there and think there are too many kids there. I've been there 13 months and always paid my rent on time. Is there any legal recourse I can take?

I am not an attorney who is licensed in your state. I suggest you consult with an attorney. However, it seems unlikely that your lease would contain a provision to authorize the termination as you have set forth. However, your lease must be reviewed to determine this fact. I suggest you call the management and see if you can amicably work this matter out. All they may want is to obtain a clear indication that you will control your child. It was improper for your child to even enter an empty unit and could have placed her in danger. See if you can work it out. I would defend the eviction proceeding in any event. This complex must be having some difficult problems with vandelism and probably feels forced to take a stand. Hope you can resolve this matter. Good luck.
