Legal Question in Traffic Law in Arizona

I recieved a photo radar ticket in el mirage , arizona on 11-5-2011. I got the original photo ticket in the mail and trcieved nothing further. Never served or alternenate served. I looked onlone and I have an arrainment date on 5/19/12. How is this possible when I was never properly served. What about the 120 day rule?

Please let me know if I have to go to the court date if I was never served. Thanks

You should go or contact the court and explain. If you do not, they will think you were served and just did not show up so they will likely enter a default judgment against you. In other words you would be held responsible for the offense and if you did not then pay the ticket they would suspend your license.

However, you said "Arraignment"? If so, that means it is likely criminal and that is a whole other story. If you were going 20mph over the speed limit the offense becomes criminal. Then if you do not show up to the court they will issue a warrant for your arrest.

You may be in the right in the situation, but it will still likely cause a bigger mess for you if you just don't show up or contact them.
