Legal Question in Wills and Trusts in Arizona

My husband died recently and left a leased car in HIS NAME and SS# ONLY. Am I responsible to pay for this car? Can I return the car to the dealer with my husband's death certificate and walk away?

Yes, you can turn the car into the lease company (which may be different than the dealer who sold the car) and notify the company of his death. I don't know what the lease agreement provides when the lessee passes away, and since AZ is a community property state, the lease company may be able to go after your share of the community property, if your husband's estate is not sufficient to pay what he owes under the lease agreement. It is possible that they may fail to make a claim against his estate and not go after you.
