Inheritance Tax

When a wife or husband dies and they have a Living Trust does the remaining one have to pay inheritance tax to the state and federal?

Thank you for your inquiry. I have two different points to answer.

1) estate taxes depend on the size of the estate (whether will, trust or other estate planning vehicle).

2) Normally, the surviving spouse doesn't pay the estate tax, but when the surviving spouse dies, if the estate is too big, then there may be estate taxes due. If you have an A-B trust, this helps to pass as much of the estate as possible without any estate taxes.
