Petition the Court for Legal Administration on behalf of the deceased

Relative was killed while driving in vehicle with spouse (Spouse at fault). Spouse is in comma and brain damage was sustained. Funeral home will not agree to cremation of relatives body since spouse is still living. Son (age 20) would like cremation, how do we petition the court for Administration of his mothers body? Relative and Spouse have only been married 4 months, no will for either has been found.

You would file a Petition for Appointment of Personal Representative of Estate. Since spouse is not able to act another relative could file the petition.
