Legal Question in Disability Law in Arkansas

age discrimination

if someone who is beyond experienced of a certain job and has been there for 25 years and keeps getting passed for a certain job for younger less experienced people would that be considered age discrimination?this has happened 8 times now and every one of them has only been there for less than a year where the book says you must have 18 months at this work place to qualify for this position.

From the facts that you described I think you have a case for discrimination. If you are qualified for the job and the only reason you are being passed over for it is because of your age this is age discrimination. I would contact your local bar association for a referral to a lawyer in your area that specializes in ADA discrimation. I would then contact your local EEOC and file a formal complaint. I would contact a lawyer first because you may be fired once your company finds out you filed a formal complaint. This is illegal but you will want to have a lawyer before this happens so he can document everything. Good luck.
