Home Construction Contract Dispute

We have a written contract to build our home for x amount per plans and specs. We also have informed our contractor on several occasions that no additional expenses over the contract were to be incurred without our advance knowledge and consent.

Contractor built cabinets for the house. The cabinets are built per the plans and specs on the houseplan. No changes were made by us. He was reminded prior to starting cabinets to stay within the allowance. He notified us after cabinets were framed and the doors and drawer covers were ordered that the cabinets would be over the allowance. He never gave us the overage despite several requests and reminders that he was told not to go over. His final bill included an additional amount of $8000 over his contract balance for cabinet work. We have told him we do not agree with this and never approved the overage. Are we required to pay this overage?

You said you reminded him several times not to go over the contracted amount. Was there discussions from him about needing to go over? You may not have to pay unless you agreed to it, and maybe not even then.

It usually comes down to how it is worded in the written contract. What was said only matters in certain circumstances in a contract dispute.
