Legal Question in Business Law in Arkansas

I want to purchase an available "800 vanity number" for my lawn business. This number exactly resembles the name of another local lawn business. Can I purchase and use the available number without getting sued? Would it be considered unethical for my to purchase that number?

I also want to trademark a specific nickname called NWA YARD GUY so no one else can use it. And I want to use that nickname to market my business and put it on business cards and vehicle magnets. Is that possible?

As a Franchise Attorney I can advise on the trademark issue. You can probably trademark (actually service mark, since you're providing a service) NWA YARD GUY. Problem is, someone could probably use ABC YARD GUY. So, you want to lock up YARD GUY, if possible. Consult with a good trademark or franchise attorney in your area for specific advice.
