Legal Question in Civil Rights Law in Arkansas

mentaly ill arrested

My brother who was and is under doctor care for mental illness has been arrested and is being held in a jail in a very small town. He has sustained head injurys and his speech is slurred and unusally slow. Police say he refusses medical attention. I want to have him hospitalized and kept for evaluation, I believe thier could be brain damage from injurys recieved both before and after arrest. (they said he fell out of bed) Is there any thing I can do, or any one I can write to, to ask for help getting him in for treatment and out of all that ''home cooking''

Re: mentaly ill arrested

You have recourse under federal law. Your brother has consitutional and statutory rights to proper medical treatment considering all the circumstances. You should move quickly to get an attorney involved. You will get no cooperation from the prison authorities without a court order.

The best thing that you can do for your brother is to get him a very well-respected attorney who not oly has experience in criminal law but has enough of a reputation that he will force his will on the court. His client deserves medical treatment, plain and simple. Push until you get it.
