shoplifting

i got cought shoplifting. i took 398.00 worth of stuff.is that a mistamenor or a felony? when i got aressted the officer didnt read me my rights,is there any thing i can do about that? they also said that i was band from wal-mart for life can they do that? i was just wanting information on what will happen on my first offence i dont understand any of it. please help me understand if you can! thank you for your time.

Thank you for your question. The level for a felony is $500.00, unless a fight took place. If there was a fight when you were arrested, some prosecutors have been charging Robbery, which is a felony. The potential penalty for misd shoplifting is $1,000 fine and one year in jail. The potential penalty for Robbery is 5 to 20 years in prison and $15,000 fine.

As to WM, yes they can ban you forever. They are a private company and they can say never come back. If you do, you can be charged with criminal tresspass, another misdomeanor. Next, I will tell you about what we call the "Wal-Mart Law". It is called that because WM was very instrumental in getting it passed. What it says is that they can collect $200 from you by sending you a letter demanding it. If you don't pay it, they can then sue you and get $1,000. The law is, in my opinion unconstitutional and I have never had a client pay the fine. That is a civil penalty which is different from the criminal penalty listed above.
